Welcome to Poliada ("we", "our", or "us"). These Terms of Use ("Agreement") govern your access to and use of our ecosystem, platform, games, and related services. By accessing or using our services, you agree to comply with these Terms of Use. If you do not agree, please refrain from using our services.

 

Poliada offers an innovative ecosystem for developers to integrate their games, create marketplaces, and utilize the PADA token for transactions. Our flagship game, Poliada: Tactical, demonstrates the potential of the ecosystem and serves as a benchmark for other developers.

 

2. Ecosystem Utility, NFTs, and In-Game Purchases

 

a. PADA Token Utility

 

Core Functionality: The PADA token is the core utility token within the Poliada ecosystem. It facilitates a wide range of transactions, including the purchase of in-game resources, levels, bonuses, and other items designed by developers.

 

Flexible Use Cases: Developers can integrate the PADA token into their games for diverse purposes, such as enabling premium content, granting access to exclusive features, or facilitating token-based transactions.

 

b. In-Game Purchases and Resources

 

Broad Availability: Players within the ecosystem can purchase various in-game assets, including resources, levels, bonuses, and other unique items created by developers. These purchases enhance the gameplay experience and support creative game designs.

 

Seamless Transactions: All transactions are facilitated by PADA tokens, leveraging Polygon's infrastructure to ensure low transaction fees and fast processing times.

 

c. NFT Integration

 

Optional Utility: Developers can choose to tokenize game assets as Non-Fungible Tokens (NFTs) to offer benefits such as ownership, trading, and access to exclusive content.

 

Special Features: Ownership of specific NFTs may grant access to unique features, resources, or areas within the ecosystem. These features are subject to change as the games and ecosystem evolve.

 

Non-Refundable Purchases: All NFT sales are final, and no refunds will be issued under any circumstances once the transaction is completed.

 

d. Ecosystem Transparency and Accountability

 

Developer Policies: Developers integrating with the Poliada ecosystem are required to adhere to ecosystem policies to ensure transparency, fairness, and reliability for all users.

 

User Confidence: Measures such as staking requirements for developers enhance security and build trust by safeguarding users' interests.

 

3. Token Staking and Ecosystem Participation

 

a. User Staking and Benefits

 

Participation Opportunities: Users can stake their PADA tokens to unlock exclusive benefits within the ecosystem. These may include enhanced in-game features, access to special resources, and additional rewards designed by developers or the ecosystem.

 

Staking Terms: Specific terms and conditions for staking, including eligibility, rewards, and policies, will be outlined in a separate Staking Agreement.

 

b. Developer Staking for Security

 

Security Assurance: Developers integrating with the Poliada ecosystem are required to stake a predetermined amount of PADA tokens. This ensures user protection and guarantees the delivery of purchased resources or assets.

 

Dispute Resolution: Staked funds act as collateral to resolve disputes or issues, fostering trust and transparency between developers and users.

 

c. Poliada Underground

 

Exclusive Access for Stakers: Users who stake PADA tokens may gain entry to the "Poliada Underground," a specialized zone within the ecosystem where participants can vote on ecosystem improvements, propose new game features, and collaborate on updates.

 

Community Collaboration: The Poliada Underground promotes community engagement and gives token holders an active role in shaping the future of the ecosystem.

 

4. Game Development and Updates

 

a. Ongoing Development

 

Continuous Improvement: The Poliada ecosystem, including its flagship game and third-party integrations, is an ever-evolving platform. We are committed to releasing regular updates, enhancements, and new content to ensure users experience fresh and engaging gameplay. This includes improving user interface designs, introducing new mechanics, and adding gameplay elements aligned with our vision for innovation.

 

Dynamic Features: We actively utilize user feedback, developer contributions, and market trends to maintain the Poliada ecosystem's competitiveness and relevance. This ensures lasting value for both users and developers.

 

b. Feature Adjustments

 

User Participation and Feedback: Changes and updates to features, mechanics, and resources are integral to maintaining a vibrant ecosystem. Token holders are encouraged to participate in the decision-making process through the Poliada Underground platform.

 

Transparent Updates: All updates and changes are communicated in advance whenever possible, ensuring users and developers remain informed about adjustments affecting gameplay, functionality, or project direction.

 

c. Developer Contributions

 

Third-Party Innovations: The Poliada ecosystem thrives on the creativity and expertise of external developers. These contributors can introduce unique mechanics, exclusive content, and innovative gameplay experiences, enriching the platform for all participants.

 

Support for Developers: Poliada provides tools, including SDKs, APIs, and documentation, to facilitate seamless integration. Technical support and community resources are available to help developers succeed in creating unique experiences.

 

d. Ecosystem Flexibility

 

Collaborative Evolution: The Poliada ecosystem evolves through collaboration between our in-house team, external developers, and community feedback. This ensures sustainability and adaptability in response to user needs and industry advancements.

 

Expanding Opportunities: Updates and features aim to not only improve existing systems but also introduce new opportunities, such as advanced monetization tools, enhanced gameplay, and increased token utility.

 

5. User Conduct and Compliance

 

a. Expected User Behavior 

 

Compliance with Laws: Users must comply with all applicable local, national, and international laws and regulations while using the Poliada ecosystem. This includes, but is not limited to, laws related to online behavior, intellectual property, and financial transactions.

 

Respect for Community: Users are expected to interact respectfully with other participants, including players, developers, and team members. Any behavior deemed abusive, harassing, or harmful is strictly prohibited.

 

Prohibited Activities: Engaging in fraudulent, deceptive, or malicious activities, such as hacking, phishing, or exploiting vulnerabilities, is forbidden. Violators may face immediate account suspension or termination.

 

b. Platform Integrity
 

 

No Unauthorized Use: Users may not reverse-engineer, disassemble, or tamper with the platform’s code, services, or infrastructure. Attempts to gain unauthorized access to accounts, wallets, or developer content are strictly prohibited.

 

Marketplace and Game Rules: Users must adhere to rules and guidelines for transactions and participation within games or the ecosystem. This includes fair trade practices and compliance with in-game regulations.

 

c. Account Responsibility

 

Account Security: Users are responsible for securing their account credentials, including wallet keys and passwords. Activities conducted through an account will be presumed to have been performed by the account holder unless proven otherwise.

 

Reporting Misuse: Users are encouraged to report suspicious or abusive activities to Poliada’s support team. Prompt reporting ensures a safe and fair environment for all participants.

 

d. Consequences of Violations

 

Warning and Suspension: Minor infractions may result in warnings or temporary account suspensions. Serious or repeated violations can lead to permanent account termination.

 

Legal Action: In severe cases, Poliada reserves the right to take legal action, including seeking damages or involving law enforcement authorities.

 

e. Developer Code of Conduct

 

Commitment to Fair Play: Developers must ensure their games and systems are fair, transparent, and safe for users. Deceptive practices, such as false advertising or unfair advantages, are strictly prohibited.

 

Adherence to Guidelines: Developers must comply with Poliada's technical and operational guidelines, including staking PADA tokens, ensuring data protection, and maintaining ecosystem standards.

 

6. Limitation of Liability

 

a. General Disclaimer

 

As-Is and As-Available Basis: The Poliada ecosystem, including all games, platforms, services, and features, is provided on an “as-is” and “as-available” basis. While we strive to ensure reliability and functionality, we do not guarantee uninterrupted access, error-free operation, or the availability of specific features.

 

b. No Liability for Losses

 

Token Transactions: Poliada and its affiliates are not liable for any financial losses resulting from token transactions, including token price fluctuations, failed transactions, or wallet misuse. Users are advised to exercise caution when interacting with blockchain technologies.

 

In-Game Purchases: We assume no liability for losses or refunds related to in-game purchases, including NFTs, levels, bonuses, or other resources. All transactions are final once completed.

 

Developer Contributions: Poliada is not responsible for content, mechanics, or transactions created by third-party developers within the ecosystem. Users interact with these at their own risk.

 

c. Limitation on Damages

 

Exclusion of Certain Damages: Poliada shall not be liable for indirect, incidental, consequential, or punitive damages, including loss of profits, data, or goodwill, to the fullest extent permitted by applicable law.

 

Liability Cap: In jurisdictions where liability limitations are restricted, Poliada’s maximum liability for any claim will not exceed the amount of fees paid directly to Poliada for the specific service or feature in question.

 

d. User Acknowledgment

 

Assumption of Risk: By using the ecosystem, users acknowledge the risks associated with blockchain technology, cryptocurrency transactions, and digital platforms, including token volatility and system vulnerabilities.

 

Third-Party Responsibility: Poliada is not liable for issues caused by third-party platforms, wallets, or services, including those related to the Polygon blockchain or external marketplaces.

 

e. Indemnification

 

User Obligation: Users agree to indemnify and hold harmless Poliada, its affiliates, employees, and partners from any claims, damages, or expenses arising from their use of the ecosystem or violations of this Agreement.

 

7. Amendments and Updates

 

a. Right to Modify

 

Terms and Conditions: Poliada reserves the right to modify, update, or amend these Terms of Use at any time. Changes may reflect updates to the ecosystem, token policies, or compliance requirements.

 

Notification of Changes: Significant updates will be communicated via email (if applicable) or prominently displayed on our platform. Users are responsible for reviewing such updates.

 

b. User Acceptance

 

By continuing to use the Poliada ecosystem after modifications, users indicate acceptance of the updated Terms of Use. If users do not agree, they must discontinue use of the ecosystem immediately.

 

c. Versioning and Archives

 

Poliada may archive previous versions of the Terms of Use for transparency. Users can request access to past versions by contacting compliance@poliada.io.

 

d. Regulatory Adjustments

 

Changes to the Terms of Use may be necessary to align with evolving legal, regulatory, or blockchain standards in Costa Rica, depending on compliance requirements and the structure of the ecosystem entity.

 

8. Governing Law and Jurisdiction

 

a. Governing Law

 

These Terms of Use and any disputes or claims arising from or related to them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of Costa Rica, without regard to conflict of law principles.

 

All matters related to the infrastructure, ecosystem, platform operations, marketplace interactions, and purchases shall be subject exclusively to Costa Rican law.

 

b. Jurisdiction

 

All legal proceedings related to these Terms of Use shall fall under the exclusive jurisdiction of the courts located in Costa Rica. By using the Poliada ecosystem, users agree to submit to the personal jurisdiction of these courts.

 

c. Compliance Across Jurisdictions

 

While Poliada acknowledges the existence of global legal requirements, the primary legal and regulatory framework governing the Poliada ecosystem — including infrastructure, platform services, and user interaction — is based in Costa Rica.
